01Kto przetwarza Twoje dane

Technologicznej 2, 45-839 Opole, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego pod numerem KRS 0001061540 przez Sąd Rejonowy w Opolu, VIII Wydział Gospodarczy Krajowego Rejestru Sądowego, NIP 7543363294, REGON 526545471, kapitał zakładowy 10 000 zł. Marka Marta Hamouda Mentoring działa w ramach tej spółki.
We wszystkich sprawach dotyczących danych osobowych napisz na marta@hamouda.expert. Spółka nie powołała inspektora ochrony danych, więc piszesz wprost do osoby, która decyduje.
02Jakie dane zbieram
Diagnoza decyzyjna liczy się w całości w Twojej przeglądarce. Dane wychodzą ze strony w jednym momencie: kiedy przed zobaczeniem wyniku wypełniasz formularz i zaznaczasz zgodę. Wysyłane jest wtedy:
- imię i nazwisko,
- adres e-mail,
- numer telefonu w WhatsApp, razem z krajem i numerem kierunkowym, które przy nim wybrałaś,
- treść obu zgód — tej wymaganej i tej marketingowej — w brzmieniu, w jakim je zobaczyłaś, oraz moment ich wyrażenia,
- odpowiedzi na oba pytania otwierające: czego dotyczy odkładana decyzja i co najbardziej utrudnia Ci jej podjęcie. Jeżeli w którymkolwiek z nich wybrałaś „inne” i wpisałaś własnymi słowami, wysyłany jest wpisany przez Ciebie tekst,
- wszystkie dwanaście odpowiedzi razem z treścią wybranych wariantów,
- punktacja: wynik każdego pytania, wynik każdej z trzech sekcji i wynik łączny,
- ustalona trasa rozmowy wraz z uzasadnieniem oraz pasmo wyniku, o którym piszę w punkcie 04,
- język, w którym wypełniałaś diagnozę, i data wysłania.
Nie zbieram Twojego adresu IP w żadnym własnym narzędziu, nie prowadzę analityki i nie osadzam na tej stronie żadnych skryptów zewnętrznych. Serwer hostingu może zapisywać dane techniczne we własnych logach — patrz punkt 05.
03Po co i na jakiej podstawie prawnej
- Kontakt z Tobą i marketing bezpośredni — omówienie wyniku, propozycja terminu rozmowy, materiały o mentoringu decyzyjnym. Podstawą jest Twoja zgoda, art. 6 ust. 1 lit. a RODO, wyrażona przez zaznaczenie okienka przed wynikiem. Dla wiadomości e-mail i kontaktu przez WhatsApp dochodzi do tego zgoda na otrzymywanie informacji handlowej, odrębna dla każdego kanału, wymagana przez art. 398 Prawa komunikacji elektronicznej.
- Przygotowanie się do rozmowy z Tobą — Twoje odpowiedzi i wynik są tym, od czego zaczyna się rozmowa, zamiast pytania „to od czego zaczniemy”. Podstawą jest ta sama zgoda, a po jej ewentualnym wycofaniu — prawnie uzasadniony interes, art. 6 ust. 1 lit. f RODO.
- Obrona przed roszczeniami i wykazanie, że zgoda została udzielona — prawnie uzasadniony interes, art. 6 ust. 1 lit. f RODO, oraz obowiązek rozliczalności, art. 5 ust. 2 RODO.
Zgodę możesz wycofać w każdej chwili, pisząc na marta@hamouda.expert. Wycofanie nie wpływa na to, co zdarzyło się wcześniej, na podstawie zgody, zanim ją wycofałaś.
04Jak działa punktacja diagnozy
To jest profilowanie w rozumieniu art. 4 pkt 4 RODO i wolę powiedzieć to wprost. Każdej z dwunastu odpowiedzi przypisana jest liczba punktów od 0 do 5. Punkty sumują się do wyniku z maksimum 60. Dwa pytania — o miesięczny koszt zwłoki i o wielkość Twoich udziałów w firmie — działają jak progi niezależne od sumy. Wynik i te dwa progi decydują, którą z dwóch rozmów Ci proponuję: mentoring decyzyjny albo warsztat.
Poza trasą wynik plasuje Cię w jednym z czterech pasm, od „Samo rozstrzygnięcie” po „To jeszcze nie decyzja”. Pasma nie zobaczysz na ekranie — idzie ono razem z resztą do mnie i mówi mi, od czego zacząć rozmowę. Piszę o tym wprost, bo nie chcę, żeby jakakolwiek część tej oceny była przed Tobą schowana.
Nie jest to zautomatyzowane podejmowanie decyzji wywołujące wobec Ciebie skutki prawne ani podobnie istotne, o którym mowa w art. 22 RODO. Wynik nie zamyka Ci żadnej drogi — ustala tylko, od czego zaczyna się rozmowa z człowiekiem. Jeżeli chcesz poznać punktację swoich odpowiedzi, napisz, a ją dostaniesz.
05Komu przekazuję Twoje dane
Nie sprzedaję danych i nie udostępniam ich do cudzego marketingu. Korzystam z podmiotów, które przetwarzają je na moje zlecenie:
- Make — Make Technologies s.r.o., spółka zależna Celonis SE z siedzibą w Monachium. Formularz przed wynikiem wysyła dane wprost do scenariusza w Make w strefie EU2, czyli w Dublinie w Irlandii, na infrastrukturze AWS
eu-west-1. Scenariusz przekazuje je dalej do narzędzi wymienionych niżej. Ten etap nie wychodzi poza Unię Europejską.
- Google Cloud Poland Sp. z o.o. — Arkusze Google, w których prowadzę rejestr zgłoszeń, oraz poczta dla adresu marta@hamouda.expert. Region
europe-central2, czyli Warszawa.
- Brevo (Sendinblue SAS, Francja) — rezerwacja terminu rozmowy, jeżeli z niej skorzystasz. Do Brevo trafia tylko to, co sama wpiszesz przy rezerwacji; wynik diagnozy nie jest tam przekazywany.
- Namecheap — hosting tej strony, w europejskim centrum danych dostawcy w Amsterdamie w Holandii. Serwer zapisuje w logach zwykłe dane techniczne żądania: adres IP, datę i godzinę, adres strony, typ przeglądarki.
Wszyscy powyżsi dostawcy przechowują dane w Unii Europejskiej. Część z nich należy do grup mających podmioty poza EOG i nie da się całkowicie wykluczyć dostępu serwisowego z państwa trzeciego. Taki transfer jest objęty standardowymi klauzulami umownymi Komisji Europejskiej (art. 46 ust. 2 lit. c RODO), a tam, gdzie dostawca jest certyfikowany — decyzją o adekwatności EU–US Data Privacy Framework z 10 lipca 2023 r. Kopię zabezpieczeń wyślę na życzenie.
WhatsApp jest usługą Meta. Jeżeli napiszę do Ciebie w WhatsAppie albo Ty napiszesz do mnie, treść tej rozmowy podlega także zasadom Meta, na które nie mam wpływu.
06Jak długo przechowuję dane
- Dane kontaktowe i wynik diagnozy, gdy zaznaczyłaś zgodę marketingową — do wycofania przez Ciebie zgody albo 3 lata od ostatniego kontaktu, zależnie od tego, co nastąpi wcześniej.
- Dane kontaktowe i wynik diagnozy, gdy zgody marketingowej nie zaznaczyłaś — 12 miesięcy, potem usuwam.
- Dowód udzielenia zgody — 3 lata od zakończenia przetwarzania, zgodnie z ogólnym terminem przedawnienia roszczeń (art. 118 k.c.).
- Dane w logach serwera — przez okres retencji stosowany przez Namecheap jako dostawcę hostingu. Nie prowadzę własnej kopii tych logów ani nie przedłużam tego okresu.
07Twoje prawa
Masz prawo do: dostępu do swoich danych i kopii, sprostowania, usunięcia, ograniczenia przetwarzania, przenoszenia danych, sprzeciwu wobec przetwarzania opartego na prawnie uzasadnionym interesie oraz wycofania zgody w każdej chwili. Sprzeciw wobec marketingu bezpośredniego działa zawsze i nie muszę go z Tobą uzgadniać.
Żeby skorzystać z któregokolwiek z tych praw, wystarczy jedna wiadomość na marta@hamouda.expert. Masz też prawo wnieść skargę do Prezesa Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warszawa.
08Czy musisz podać dane
Nie. Podanie danych jest dobrowolne. Jest jednak warunkiem zobaczenia wyniku diagnozy na tej stronie — bez wypełnienia formularza i zaznaczenia zgody wynik się nie pokaże. Możesz też po prostu napisać do mnie bez wypełniania diagnozy.
09Co strona zapisuje w Twojej przeglądarce
Ta strona nie ustawia ciasteczek. Zapisuje natomiast dwie rzeczy w pamięci lokalnej Twojej przeglądarki, żeby diagnoza działała. Opisałam to osobno w polityce cookies i pamięci lokalnej.
10Zmiany tej polityki
Jeżeli zmieni się to, co robię z danymi, zmienię ten dokument i podam nową datę na górze. Jeżeli zmiana będzie dotyczyła podstaw przetwarzania Twoich danych, dostaniesz o niej wiadomość na adres, który zostawiłaś.

This site collects data in exactly one place: the form that comes before your Decision Diagnostic result. What happens to it is written below, without sending you to another document.
01Who processes your data
The controller of your personal data is NEXIA GLOBAL Sp. z o.o., seated at ul. Technologiczna 2, 45-839 Opole, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS 0001061540 kept by the Sąd Rejonowy w Opolu, VIII Wydział Gospodarczy Krajowego Rejestru Sądowego, NIP 7543363294, REGON 526545471, share capital PLN 10,000. The Marta Hamouda Mentoring brand operates within that company.
For anything concerning personal data, write to marta@hamouda.expert. The company has not appointed a Data Protection Officer, so you are writing directly to the person who decides.
02What data is collected
The Decision Diagnostic is scored entirely in your browser. Data leaves this page at one moment only: when you fill in the form before seeing your result and tick the consent box. What is sent then is:
- your first and last name,
- your email address,
- your WhatsApp phone number, together with the country and dialling code you selected beside it,
- the wording of both consents — the required one and the marketing one — exactly as you saw them, and the moment you gave them,
- your answers to both opening questions: what the postponed decision is about, and what makes it hardest to take. If you chose "other" in either one and typed your own words, the text you typed is sent,
- all twelve answers together with the wording of the option you chose,
- the scoring: points per question, points for each of the three sections, and the total,
- the route the result leads to, with the reasoning behind it, and the band described in section 04,
- the language you answered in, and the time of submission.
No IP address is collected in any tool of mine, there is no analytics, and no third-party script is embedded in this page. The hosting server may record technical data in its own logs — see section 05.
03Why, and on what legal basis
- Contacting you and direct marketing — the read-out of your result, a proposed time for a conversation, material about decision mentoring. The basis is your consent, Art. 6(1)(a) GDPR, given by ticking the box before the result. For email and WhatsApp messages, consent to receive commercial information also applies, given separately for each channel, as required by art. 398 of the Polish Electronic Communications Law.
- Preparing for our conversation — your answers and your result are where the conversation starts, instead of "so where shall we begin". The basis is that same consent, and after any withdrawal of it, legitimate interest under Art. 6(1)(f) GDPR.
- Defending against claims and demonstrating that consent was given — legitimate interest under Art. 6(1)(f) GDPR, and the accountability obligation under Art. 5(2) GDPR.
You can withdraw your consent at any time by writing to marta@hamouda.expert. Withdrawing it does not affect what was done earlier, on the basis of that consent, before you withdrew it.
04How the diagnostic scoring works
This is profiling within the meaning of Art. 4(4) GDPR, and it should be said plainly. Each of the twelve answers carries between 0 and 5 points. The points add up to a score out of 60. Two questions — the monthly cost of the delay, and the size of your stake in the company — act as thresholds independent of the total. The score and those two thresholds determine which of two conversations is offered to you: decision mentoring, or the workshop.
Beyond the route, your score places you in one of four bands, from "Samo rozstrzygnięcie" to "To jeszcze nie decyzja". You will not see the band on screen — it travels with everything else to me, and tells me where to start the conversation. I am saying so plainly because no part of this assessment should be hidden from the person it is about.
This is not automated decision-making producing legal effects concerning you or similarly significantly affecting you within the meaning of Art. 22 GDPR. The result closes no door — it only sets where a conversation with a human being starts. If you want to see the points behind your answers, ask and you will get them.
05Who your data is shared with
Your data is never sold and never released for anyone else's marketing. The following parties process it on my instructions:
- Make — Make Technologies s.r.o., a subsidiary of Celonis SE of Munich, Germany. The form before the result sends your data straight into a Make scenario in the EU2 zone, that is Dublin, Ireland, on AWS
eu-west-1. The scenario passes it on to the tools below. This leg does not leave the European Union.
- Google Cloud Poland Sp. z o.o. — Google Sheets, which is my record of submissions, and the mailbox behind marta@hamouda.expert. Region
europe-central2, that is Warsaw.
- Brevo (Sendinblue SAS, France) — booking a time for the conversation, if you use it. Brevo receives only what you enter when booking; your diagnostic result is not passed to it.
- Namecheap — hosting for this site, in the provider's European datacentre in Amsterdam, the Netherlands. The server records ordinary technical request data in its logs: IP address, date and time, the page requested, browser type.
Every provider above stores data inside the European Union. Some belong to groups with entities outside the EEA, and support access from a third country cannot be ruled out entirely. Where that happens the transfer is covered by the European Commission's standard contractual clauses (Art. 46(2)(c) GDPR) and, where the provider is certified under it, the EU–US Data Privacy Framework adequacy decision of 10 July 2023. I will send you a copy of the safeguards on request.
WhatsApp is a Meta service. If I write to you there, or you write to me, the content of that conversation is also subject to Meta's own terms, which are outside my control.
06How long data is kept
- Contact details and diagnostic result, where you ticked the marketing consent — until you withdraw it, or 3 years from our last contact, whichever comes first.
- Contact details and diagnostic result, where you did not tick the marketing consent — 12 months, then deleted.
- Proof that consent was given — 3 years after the processing ends, following the general limitation period for claims (Art. 118 of the Polish Civil Code).
- Data in server logs — for the retention period applied by Namecheap as hosting provider. I keep no separate copy of those logs and do not extend that period.
07Your rights
You have the right to access your data and receive a copy, to rectification, to erasure, to restriction of processing, to data portability, to object to processing based on legitimate interest, and to withdraw consent at any time. An objection to direct marketing always applies and is not something I get to weigh against my own interest.
To use any of these rights, one message to marta@hamouda.expert is enough. You also have the right to lodge a complaint with the President of the Personal Data Protection Office (PUODO), ul. Stawki 2, 00-193 Warsaw, Poland.
08Do you have to give your data
No. Giving your data is voluntary. It is, however, the condition for seeing your diagnostic result on this page — without the form and the consent box, the result does not appear. You can also simply write to me without doing the diagnostic at all.
09What the page stores in your browser
This page sets no cookies. It does store two things in your browser's local storage so that the diagnostic works. That is described separately in the cookie and local storage policy.
10Changes to this policy
If what I do with data changes, this document changes with it and carries a new date at the top. If a change concerns the basis on which your data is processed, you will get a message at the address you left.
